Your use of our Services, and any dispute over privacy, is subject to this Policy and our Terms of Services, which are incorporated by reference into this Policy and include applicable limitations on damages and the resolution of disputes.
Personal Information We Collect From You
All visitors to our website may browse our website and see general information about BoatSetter. However, to register for an account with BoatSetter, you must provide us with your name, email address, and password. To register a boat via our Services, you must also provide your age and address. As part of the underwriting process we may collect additional information from you, such as driving and criminal conviction history, loss history, and other information normally collected in similar insurance related underwriting processes.
We may also collect your mobile phone number, email address, and/or instant message (“IM”) screen name when you register with us or send a mobile text message to BoatSetter’s short code (69302). A verification message may be sent to the mobile phone number, email address, and/or IM screen name that you provide. You must verify each piece of contact information to begin receiving messages via your selected communication channels. If you do not verify the contact information that you provide us, you will not be able to receive messages via your selected channel.
We also collect information about the services you use and other activities on our website.
Communications with Us:
If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We may also retain any messages you send through the Services. You may provide us information when you post User Content to the Services. BoatSetter does not intentionally collect or save any information from children 13 years of age.
To use our Services, BoatSetter will collect your payment information. We may allow you to pay using third-party services, such as PayPal, or by paying us directly via credit card or another method. By submitting your payment information, you authorize BoatSetter to access and use this information in order to process your payment, and, if you choose, to store your payment information for future payments. This allows us both to confirm your identity and provide you with seamless, hassle-free transactions. You can check the current fees, fines, and penalties applicable to use of our Services in our Fee Schedule.
For certain Services, we may require that you grant us permission to check your driver’s record to make sure you meet BoatSetter safety standards. By registering for such services and granting your consent, you authorize us to access your driver’s record from state DMVs, RMVs, and other applicable entities, and you authorize these entities to release this information to BoatSetter. BoatSetter’s authorization to check your records is ongoing throughout the time you use our Services.
Boat History and Inspection:
If you own a boat that is used on BoatSetter, we may require the inspection of the boat and obtain a boat history report. By registering with BoatSetter, you authorize us to obtain this information and you authorize applicable entities such as DMVs, inspection companies and mechanics to release such information to BoatSetter.
Cookies and Tracking Technologies
Activities While Logged In:
We or our third-party providers may log each visit to our website as well as the activities within the Services. A log entry can contain information typically found in the “header” of your web browser’s request, such as the browser type you used, your IP address, the date and time of access, and your referring URL. We or our third-party providers may also log your cookie’s identification number. This log information is important for security, audit, quality improvement, as well as for monitoring the health of our Services, and developing new Services.
When you use the Services, we or our third-party service providers may employ clear gifs (also known as web beacons and pixel tags) which are used to track the online usage patterns of our users. In addition, we or our third-party service providers may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make the company better for our users.
We may also engage third parties to track and analyze website data. We use the data collected by such third parties to help us administer and improve the quality of the website and to analyze website usage. Such third parties may combine the information that we provide about you with other information that they have collected. This Policy does not cover such third parties’ use of the data.
We use automated devices and applications, such as Google Analytics, and other analytics means to help us improve our Services, performance, and user experiences. Google Analytics and these providers may collect your IP address and associated information to provide their services to us.
Do Not Track:
Currently, our website does not honor Do-Not-Track browser requests.
Data Gathered from In-Boat Hardware:
If a GPS tracking device is installed on your boat, and you activate that device with BoatSetter, we may gather information about your boat use, including time of use, location, speed of travel, and other aspects of your boat use. We use this information 1) to provide you with the Services, 2) to aggregate your use habits and potentially provide you with related benefits such as better insurance rates or other perks for safe boating, 3) to record boat movements and driver behavior in case of an accident or theft, and 4) to aggregate your data with other boaters’ data and better understand how people use our Services and how we can make it even better for in the future.
If you are renting a boat, and the boat is GPS tracking enabled the Owner of the boat may be able to see the location of the rented boat. Your location information may be released to insurance companies, law enforcement, or similar parties in the due course of investigating and processing accident claims, providing you with help in the case of an emergency, or where required by law or legal process.
How We Use Your Information
In general, we use the information we collect from you to provide our Services, to analyze and improve our Services and develop new Services, to provide customer service and technical support, and to communicate with you. To accomplish this objective, we may access your account information and monitor your account activity from time to time.
Moreover, if you contact us with questions or concerns, we may also access your account and information in order to research and respond to your questions and concerns, as well as, to provide you with technical or customer support.
By providing BoatSetter your email address, you consent to our using the email address to send you Service-related notices, including any notices required by law. You also agree that we may send you notifications of activity on the Services to the email address you give us, in accordance with any applicable privacy settings. For instance, if you are a boat Owner, we will send you information about your boat’s charter status. You can turn these notifications off or modify how often and in what form you receive them.
If you opt-in, BoatSetter may send you other messages, including text messages (with your consent) and/or IMs, in the course of operating our Services. You may turn off these messages by adjusting your settings on the Services.
How We Share Your Information
Personally Identifiable Information:
Affiliates and Services Providers. BoatSetter may share your personally information with affiliates and third parties for the purpose of providing the Services to you. If we do this, such third parties’ use of your information will be bound by this Policy.
Transfer of Assets. As we develop our business, we may buy or sell assets or business offerings, including customer, email, and visitor information, which are generally some of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, bankruptcy, or dissolution.
Publically Posted Information. Any personal information or content that you voluntarily disclose for posting to the Services, such as User Content, becomes available to the public, as controlled by any applicable privacy settings. If you remove information that you posted to the Services, copies may remain in BoatSetter’s systems, or viewable in cached and archived pages of the Services, or by others if other Users have copied or saved that information.
Other Transfers. BoatSetter may also share personal information with third parties as follows:
• To comply with the law, a judicial proceeding, court order, or other legal process served on us or our affiliates;
• To investigate, prevent, or take action regarding suspected or actual illegal activities or threats; provide evidence in litigation in which BoatSetter is involved; investigate and defend BoatSetter and its affiliates against any third-party claims or allegations; and take precautions against liability;
• To enforce our Terms of Services and this Policy;
• To assist government enforcement agencies;
• To protect the security or integrity of our website and Service; and
• To exercise or protect the rights, property, or personal safety of BoatSetter, our Users, or others.
Joint Marketing; Expanded Services:
We may use information about you in partnership with outside companies in the course of providing you with additional services related to BoatSetter. When you choose to participate in rewards programs, contests, discount offers, or other programs that involve third parties, you authorize BoatSetter to share your personal information with those parties. In these cases we will only share the information reasonably needed to provide you with our Services. We may also share your information with third parties that offer products and services that we believe may be of interest to you. Information that is shared with third parties is subject to the privacy policies of those parties, which may differ from this Policy. By sharing this information, you agree that BoatSetter is not liable or responsible for the actions or inactions of third parties.
We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain BoatSetter Services.
Third Party Ad Networks
We use third parties such as network advertisers to display advertisements about BoatSetter on third-party websites and on our websites. Network advertisers display advertisements, based on your visits to our Services as well as other websites. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested.
You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”). We use Google AdWords Remarketing to advertise Boatsetter across the Internet, in particular on the Google Display Network.
AdWords remarketing will display ads to you based on what parts of the Boatsetter website you have viewed by placing a cookie on your web browser.
This cookie does not in any way identify you or give access to your computer or mobile device.
The cookie is used to indicate to other websites that “This person visited a particular page, so show them ads relating to that page.”
Google AdWords Remarketing allows us to tailor our marketing to better suit your needs and only display ads that are relevant to you.

Special Information for California Residents:
If you are a resident of California, you may request a list of certain third parties to whom we have disclosed personally information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us at email@example.com. Please allow up to thirty (30) days for a response.
How We Protect Your Information
BoatSetter uses commercially reasonable safeguards to protect the personal information we collect. We cannot, however, ensure or warrant the security of any information you transmit to BoatSetter and you do so at your own risk. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, you are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from BoatSetter, at all times.
You Control Your Information and Communications Settings
You can change your account information and preferences at any time by logging onto your account. You have the right to request and review information that BoatSetter holds about you, and the right to request changes to correct inaccuracies. When practical and possible, BoatSetter will make these requested changes.
All subscribers have the ability to unsubscribe or change their personal subscription settings at any time. To unsubscribe from emails from BoatSetter, click the ‘Unsubscribe’ link located at the bottom of each email. You may also call the BoatSetter Unsubscribe Hotline at 1-844-262-8738 to unsubscribe at any time.
With regard to mobile text messages, for help in the US, text HELP to 69302. You may also email firstname.lastname@example.org or call + 1-844-262-8738. You may stop mobile your subscription at any time by sending the text message STOP to Short Code 69302 in the US. Your phone must have text messaging capability. Message and data rates may apply.
If you believe that your contact information was collected by a BoatSetter user without your consent and would like to report spam, please call 1-844-262-8738. When reporting the offending organization, please include the contact address or number that sent you the spam, the username of the sender, and the message or first few sentences of the message that you consider spam.
Protecting the privacy of young children is especially important. For that reason, BoatSetter does not knowingly collect or solicit personal information from anyone under the age of 13. If we learn that we have collected personal information from a child under age 13, we will delete that information.
